Ive also seen a lawyer saying its up to the officers discretion of what to do.
He could have just handed Jamo a ticket for the infraction. No felony, no jail time.
Just a fine and a stern warning to get a Cpl.
either way i think a good lawyer will have Jamo get his CPL and have the case pled down to a misdemeanor and a fine and call it a day.
and thats IF the county prosecutor wishes to charge Jamo.
Also thank God I live in Ohio where we have Open Carry
As I understand it, the fact that it was Williamsā weapon, that it was immediately accessible to him, and that he did not have a CPL constitutes a felony.* I also understand that this falls more into the Bates area, where he maybe outta have been arrested even while it would have been unlikely for charges to be pressed.
*and no, not a lawyer either, just spent some time reading what knowledgeable people have written
Iām no legal scholar, but if we have to get so granular to find a violation, itās certainly not worth a suspension by the NFL. Iāll refrain from providing my uneducated opinion about the intricacies of MCL and violations. Who knows if the prosecutors office even moves forward with the arrest warrant or not.
There is no way this is NFL suspension worthy, but they are not known for being the most practicable with how they administer punishment under their code of conduct policy.
As i referenced with jack jones and derion kendrick, worse charges no suspension. This shouldnt even be a consideration regardless of charges brought based on what we know.
If new information arises we can reassess but based on precident i would expect jamo and the lions to argue any suspension levied
I 1000% agree, but the NFLās disciplinary process is horrendous in how itās applied. I wouldnāt be the least bit surprised if he gets a suspension regardless of what happens legally for being a repeat offender. Offender of what you might ask? NFL response - a bunch of BS gibberish, blah blah blah. Appeal? Yeah - about that process, it sucks too.
Oh i agree just saying that it makes the optics off and i would expect Sheila to have something to say given the ongoing precedents that have been set in worse cases.
But as i said not saying they cant i just believe they wont baring new information
MCL 28.432 An individual can carry, possess, use or transport a pistol belonging to another individual, if the pistol is properly licensed under the Act, and the individual carrying, possessing, using or transporting the pistol has obtained a license to carry a pistol concealed permit from Michigan.
A CPL holder can carry a gun belonging to someone else as long as the gun is legally owned. Registered owner does not have to have a CPL.
Itās considered concealed in any part of the vehicleās cabin in Michigan, hence the need for a CPL. Without a CPL, it needs to be stored specifically: unloaded, in a case, and in the trunk (or in a ānot readily accessibleā space in a vehicle sans trunk.)
I am genuinely curious what this means if jamo wasnt even in the car. Like deadstroke was saying that the brothers cpl doesnt cover jamos gun because jamo doesnt have a cplā¦ so i guess i am just trying to understand what that would mean from a michigan legal perspective.
I still believe this is a nothing burger either way for all of the reason i mentioned previously from an nfl perspective. Just curious how this works
Idk why heās listening to a lawyer instead of reading English. Lawyers argue both sides of the law, itās literally their jobā¦ But the law is the law, read it, itās easy to understand if you try (for me at least). I understand listening to qualified opinions, but the facts are in black and white.
You may be on to something but reversed. If his brother exited the vehicle leaving Jamo in the vehicle with a loaded gun, he would be guilty of carrying a concealed weapon.
My wife has her CPL just to avoid this scenario. If I go into a gun free zone and remove my gun, putting it in the glove box, my wife, staying in the truck, would be committing a felony as soon as I exited if she didnāt have her CPL.
Itās nit picking but itās the letter of the law.
I was just kidding around Tuck. Iām Canadianā¦ We drop sticks and punch each other in the faceā¦then hug after the game. The world needs more of that IMO.
See this makes sense to me though but we are acting like jamo needs to have a cpl even though his brother has one meaning his brother cant transport his gun since jamo doesnt have the cpl.
This is why i asked the question, if jamo isnt in the car does that interpretation of the law work? It seems like that cant be right to me based on that fact but i was willing to accept i dont know michigan law.
